深圳市国际航行船舶保税油经营管理办法

Measures of Shenzhen for Administration of Bonded Oil Operations for Vessels Engaged on International Voyages

第一章 总则

Chapter I General Provisions

  第一条 为进一步深化深圳市国际航行船舶保税油经营管理改革,完善经营监管制度机制,根据《深圳建设中国特色社会主义先行示范区综合改革试点实施方案(2020-2025年)》《国务院关于开展营商环境创新试点工作的意见》以及相关法律、法规、规章和文件规定,制定本办法。

  Article 1 In order to deepen Shenzhen's reform of the management of bonded oil operations for vessels engaged on international voyages and improve the related operation and supervision systems and mechanisms, these Measures are formulated in accordance with the Implementation Plan for Comprehensive Reform in Shenzhen to Build A Pilot Demonstration Area of Socialism with Chinese Characteristics (2020-2025) and the Opinions on Implementing the Pilot Program for Business Environment Innovation promulgated by the State Council, and relevant laws, regulations, rules and documents.

  第二条 本办法所称国际航行船舶保税油经营是指在深圳市(含深汕特别合作区)为国际航行船舶提供保税油供应的行为(以下简称保税油经营)。根据业务发展需要,可探索开展跨关区直供业务。

  Article 2 For the purposes of these Measures, bonded oil operations for vessels engaged on international voyages shall mean the act of providing bonded oil for vessels engaged on international voyages in Shenzhen (including the Shenshan Special Cooperation Zone) (hereinafter referred to as “bonded oil operations”). Based on business development needs, exploration of direct supply business across customs areas is permitted.

  本办法所称国际航行船舶,是指进出中华人民共和国口岸的外国籍船舶和航行国际航线的中华人民共和国国籍船舶。本办法所指保税油,是指由海关实施保税监管的国际航行船舶用油品。本办法所称跨关区直供,是指保税油经营企业跨关区将保税油直接供应到国际航行船舶上的业务。

  For the purposes of these Measures, vessels engaged on international voyages shall mean ships of foreign nationality entering and exiting ports of the People's Republic of China and ships of the People's Republic of China sailing in international routes. For the purposes of these Measures, bonded oil shall mean oil products under bonded supervision by the customs and used for vessels engaged on international voyages. For the purposes of these Measures, direct supply across customs areas shall mean the business where bonded oil operation companies directly supply bonded oil across customs areas to vessels engaged on international voyages.

  第三条 本办法适用于在深圳市(含深汕特别合作区)注册的企业开展国际航行船舶保税油经营及相关监督管理工作。

  Article 3 These Measures shall apply to the bonded oil operations of companies registered in Shenzhen (including the Shenshan Special Cooperation Zone) and related supervision and management.

  第四条 深圳市人民政府对保税油经营资质实行统一管理,总量控制,有序推动。属地区政府(含大鹏新区、深汕特别合作区管委会)、市商务局、市交通运输局、深圳海关、深圳海事局、深圳边检总站、市发展改革委、市公安局、市财政局、市规划和自然资源局、市海洋发展局、市生态环境局、市应急管理局、深圳市消防救援局、市国资委、市市场监管局、市地方金融管理局、市口岸办、深圳市税务局、国家金融监督管理总局深圳监管局、人民银行深圳市分行(国家外汇管理局深圳市分局)、深圳海警局、广东海警局直属分局等单位按照各自行政管理职责做好保税油经营监督管理工作。

  Article 4 The People's Government of Shenzhen Municipality (the “municipal government”) shall exercise unified management over bonded oil operation qualifications, control the total quantity, and promote orderly business development. District governments (including the Administrative Committees of Dapeng New District and Shenshan Special Cooperation Zone), the Commerce Bureau of Shenzhen, Transport Bureau of Shenzhen, Shenzhen Customs, Shenzhen Maritime Safety Administration, Shenzhen Exit-Entry Border Checkpoint, Development and Reform Commission of Shenzhen, Public Security Bureau of Shenzhen, Finance Bureau of Shenzhen, Planning and Natural Resources Bureau of Shenzhen, Marine Development Bureau of Shenzhen, Ecology and Environment Bureau of Shenzhen, Emergency Management Bureau of Shenzhen, Fire and Rescue Bureau of Shenzhen, State-owned Assets Supervision and Administration Commission of the People's Government of Shenzhen Municipality, Market Regulation Bureau of Shenzhen, Local Financial Regulatory Bureau of Shenzhen, Office of Port of Entry and Exit of the People's Government of Shenzhen Municipality, Shenzhen Municipal Office of the State Administration of Taxation, Shenzhen Municipal Office of the National Financial Regulatory Administration, Bank of China Shenzhen Branch (Shenzhen Office of State Administration of Foreign Exchange), Shenzhen Coast Guard, and direct branches of Guangdong Coast Guard shall supervise and administer bonded oil operations according to their administrative responsibilities.

  保税油经营批准证书发放后,属地区政府(含大鹏新区、深汕特别合作区管委会)具体承担保税油加注业务的事中事后政府管理与服务等统筹协调工作。包括但不限于推动中央驻深单位开展制度创新,加快出台保税油加注系列配套措施或办法,统筹推进保税油加注业务运营管理、加快推进深圳国际航行船舶保税燃料公共服务平台建设,探索实现保税油经营跨部门监管、审批的数字化和一体化。

  After issuing the approval certificate for bonded oil operations, district governments (including the Administrative Committees of Dapeng New District and Shenshan Special Cooperation Zone) shall coordinate in-process and ex-post government management and services regarding bonded oil bunkering business, which include but are not limited to advancing the institutional innovation by Shenzhen offices of central government organs, accelerating the introduction of a string of supporting measures for bonded oil bunkering, coordinating and promoting the operations management of bonded oil bunkering, advancing the development of Shenzhen's public service platform for bonded oil for vessels engaged on international voyages, and exploring approaches to enable the digitalization and integration of inter-departmental supervision and approval of bonded oil operations.

  第五条 保税油经营企业必须按照本办法要求取得保税油经营资格后,方可开展相关业务。保税油经营企业必须依法经营,严格执行《中华人民共和国海关法》《中华人民共和国国境卫生检疫法》《中华人民共和国进出口商品检验法》《中华人民共和国港口法》《中华人民共和国海上交通安全法》《中华人民共和国海洋环境保护法》《中华人民共和国对外贸易法》《中华人民共和国出境入境管理法》《中华人民共和国消防法》《中华人民共和国安全生产法》《中华人民共和国进出口关税条例》《国内水路运输管理条例》以及成品油市场管理相关办法等法律法规规章。

  Article 5 Bonded oil operation companies must obtain bonded oil operation qualifications in accordance with these Measures prior to carrying out such business. Bonded oil operation companies must operate according to the law and strictly implement the laws and regulations of the People's Republic of China, including the Customs Law, the Law on Frontier Health and Quarantine, the Import and Export Commodity Inspection Law, the Port Law, the Marine Traffic Safety Law, the Marine Environment Protection Law, the Foreign Trade Law, the Exit and Entry Administration Law, the Fire Protection Law, the Workplace Safety Law, the Regulations on Import and Export Duties, the Regulations on the Administration of Domestic Waterway Transport, as well as the laws, regulations and rules regarding the administration of the refined petroleum products market.

第二章 保税油经营资格管理

Chapter II Bonded Oil Operation Qualification Management

  第六条 申请保税油经营资格的企业,应具备下列条件:

  Article 6 Companies applying for bonded oil operation qualifications shall meet the following criteria:

  (一)拥有或租赁符合相关技术和安全条件的单船载重吨位不小于1000吨的双底双壳供应船舶至少1艘;如采用租赁方式,合同期限不得少于1年;

  (i) The applicant shall own or lease at least one double-bottom double-hull supply vessel with a deadweight tonnage of not less than 1,000 tons that meets the relevant technical and safety requirements. For leased vessels, the contract validity term shall not be less than one year.

  (二)拥有或租赁符合安全技术条件、满足海关监管要求,库容不低于1万立方米的油罐,且具备接卸和转运保税油等配套设施;如采用租赁方式,合同期限不得少于3年;

  (ii) The applicant shall own or lease oil tanks with a storage capacity of not less than 10,000 cubic meters that meet the safety and technical requirements and the customs supervisory requirements, and have auxiliary facilities for receiving, unloading and transshipping bonded oil; for leased oil tanks, the contract validity term shall not be less than three years.

  (三)申请企业和其股东3年内未发生较大及以上火灾、安全、环境污染事故,且无油品走私、违反出入境管理法律法规等违法违规行为。

  (iii) The applicant and its shareholders shall not have had any major or above fire, safety or environmental pollution accidents, or have committed oil product smuggling or violated the exit and entry administration laws and regulations in the past three years.

  第七条 申请保税油经营资格的企业,应当向市商务局提交以下材料:

  Article 7 Companies applying for bonded oil operation qualifications shall submit the following documents to the Commerce Bureau of Shenzhen Municipality (the “Commerce Bureau”):

  (一)企业申请文件;

  (i) Application documents;

  (二)市场监管部门核发的企业营业执照;

  (ii) Business license issued by the market regulation authority;

  (三)交通部门核发的《船舶港口服务单位备案表》;

  (iii) Ship and Port Service Organization Filing Form issued by the transport authority;

  (四)未来3年保税油经营销售商业计划书,计划书中应当详细说明股东实力背景、资源配置承诺等,可提供反映申请企业财务实力、资源保障、安全生产等方面的材料予以佐证;

  (iv) A business plan for bonded oil operations and sales for the next three years, including a detailed description of shareholders' background and strengths, resource allocation commitments, etc., which may be proved with materials reflecting the financial strengths, resource guarantee, and workplace safety of the applicant;

  (五)在海事管理机构备案的相关材料,以及供应船舶的相关检验证书;租赁船舶开展加注业务的,应提供合同有效期不少于1年的供应船舶租赁合同;

  (v) Relevant materials filed with the maritime safety administration, as well as supply vessel inspection certificates; vessel leasing contract with a validity term of no less than one year (applicable to applicants leasing vessels for bunkering business);

  (六)承运船舶应当安装船舶实时定位、质量流量计、监控设备等满足海关、海事、边检等监管单位要求的设备设施,未安装实时定位、质量流量计、监控设备等设备设施的需提供期限内安装相关设施的承诺书;

  (vi) A letter of commitment for the installation of relevant facilities within the timeframe (applicable to applicants with vessels without real-time positioning, mass flow meter, monitoring device and other equipment and facilities, as shipping vessels are required to be fitted with facilities such as real-time positioning system, mass flow meters, monitoring devices and other equipment and facilities that meet the requirements of customs, maritime affairs, border inspection and other supervision authorities);

  (七)油库及其配套设施的相关证书和文件;租赁保税油罐开展加注业务的,应提供合同有效期不少于3年的油罐租赁合同;

  (vii) Certificates and documents related to oil depots and the auxiliary facilities; oil tank leasing contract with a validity term of no less than three years (applicable to applicants leasing bonded oil tanks for bunkering business);

  (八)利用港口设施加注的,提供交通部门核发的《港口经营许可证》;除在港区内从事危险化学品仓储经营的企业外,从事列入《危险化学品目录》的危险化学品经营的,按规定提供《危险化学品经营许可证》;

  (viii) Port Operation License issued by the transport authority (applicable to applicants using port facilities for their bunkering business); Hazardous Chemicals Operation License (applicable to applicants engaged in the operation of hazardous chemicals listed in the Catalog of Hazardous Chemicals, excluding companies engaged in the storage and operation of hazardous chemicals in the port area);

  (九)申请企业和其股东3年内未发生较大及以上火灾、安全、环境污染事故以及走私油品、违反出入境管理法律法规等违法违规行为的说明。

  (ix) A description of the applicant and its shareholders not having any major or above fire, safety or environmental pollution accidents, committing oil product smuggling, or violating the exit and entry administration laws and regulations in the past three years.

  第八条 市商务局应公开保税油经营资格的事项、依据、条件、数量、程序、期限以及需要提交的全部材料的目录和申请书示范文本等。

  Article 8 The Commerce Bureau shall disclose the matters, basis, criteria, quantity, procedures, deadline, list of all documents required and an application sample regarding the application for bonded oil operation qualification.

  第九条 申请从事保税油经营资格的企业,应向市商务局提出申请,市商务局在申请人申请材料齐全、法定形式符合,或者申请人按照要求提交全部补正申请材料后,受理保税油经营资格申请。

  Article 9 Companies applying for bonded oil operation qualifications shall apply to the Commerce Bureau, and the latter shall accept the application for bonded oil operation qualifications after the applicant has submitted all documents as required or after the applicant has submitted all the supplementary documents as required.

  市商务局认为申请材料不齐全或者不符合规定的,应在收到申请之日起5个工作日内告知申请人所需补正的内容,或者将申请材料退回。逾期不告知或不退回的,自收到申请材料之日起即为受理。

  Where the submitted application documents are incomplete or do not meet the requirements, the Commerce Bureau shall inform the applicant of the documents to be supplemented or return the application documents within five days of receipt. Where the Commerce Bureau fails to do so, it shall be deemed that the application is accepted from the day the documents are received.

  市商务局受理材料后,会同属地区政府(含大鹏新区、深汕特别合作区管委会)、市交通运输局、深圳海关、深圳海事局、深圳边检总站开展综合评审,可组织专家评审,并按程序确定拟授予深圳市国际航行船舶保税油经营批准证书(以下简称批准证书)的企业名单后,上报市政府审批。

  After accepting the application documents, the Commerce Bureau shall work with the district governments (including the Administrative Committees of Dapeng New District and Shenshan Special Cooperation Zone), the Transport Bureau of Shenzhen, Shenzhen Customs, Shenzhen Maritime Safety Administration, and Shenzhen Exit-Entry Border Checkpoint to review the same. They may organize an expert panel for the review and determine the list of companies to be granted a Shenzhen approval certificate for bonded oil operations for vessels engaged on international voyages (hereinafter referred to as “approval certificate”) according to the procedures, and then report the list to the municipal government for approval.

  在受理之日起20日内对符合条件的,市商务局授予保税油经营资格并颁发批准证书;对不符合条件的,市商务局将不予批准的决定及理由书面通知企业。

  Within 20 days from the date of acceptance, the Commerce Bureau shall grant the bonded oil operation qualification and issue the approval certificate to the qualified applicant, and inform the unqualified applicant of the disapproval and reasons in writing.

  20日内不能作出决定的,经市商务局负责人批准,可延长10日,需将延长期限的理由告知申请人。

  Where a decision cannot be made within 20 days, the deadline may be extended by 10 days with the approval of the head of the Commerce Bureau, and the applicant shall be informed of the reasons.

  第十条 企业取得批准证书后,应及时向市市场监管局、市交通运输局、深圳海关、深圳海事局、国家外汇管理局深圳市分局、深圳边检总站、深圳市税务局等单位办理相关手续。

  Article 10 After obtaining the approval certificate, the applicant shall go through the relevant procedures with the Market Regulation Bureau of Shenzhen, the Transport Bureau of Shenzhen, Shenzhen Customs, the Shenzhen Maritime Safety Administration, Shenzhen Office of State Administration of Foreign Exchange, Shenzhen Exit-Entry Border Checkpoint, and Shenzhen Municipal Office of the State Administration of Taxation.

  第十一条 批准证书的有效期为3年。企业需要继续从事保税油经营活动的,应在有效期届满30日前向市商务局提出延续申请。市商务局组织有关部门审核后,上报市政府审批,对仍具备经营条件的企业按程序准予换领新证,具体时限参照第九条规定执行。

  Article 11 The validity period of the approval certificate is three years. Companies to continue their bonded oil operation shall apply to the Commerce Bureau for certificate renewal 30 days before the certificate expires. After organizing relevant departments to review the applications, the Commerce Bureau shall submit the applications to the municipal government for approval. The qualified applicant shall be granted a new certificate according to relevant procedures and deadlines set out in Article 9.

  第十二条 批准证书是从事保税油经营的重要凭证。批准证书分正本和副本,正本和副本具有同等法律效力。正本应置于企业营业场所的醒目位置。

  Article 12 The approval certificate is an important certificate for engaging in bonded oil operations. The approval certificate contains an original and a copy, and both shall have the same legal effect. The original shall be placed in a conspicuous position at the business premises.

  批准证书(正、副本)登记信息包括:证书编号、企业名称、经营地点(场所)、法定代表人(或企业负责人)、批准经营的种类、证书有效期、发证机关(签章)以及发证时间。

  The information that the approval certificate (original and copy) contains includes certificate number, company name, business premise, legal representative (or person in charge of the company), types of operations approved, validity period of the certificate, issuing authority (seal and signature) and time of issuance.

  第十三条 保税油经营企业遗失批准证书的,必须在注册地主要媒体声明作废后,向市商务局申请补领。

  Article 13 Where a bonded oil operation company loses its approval certificate, it must publish an invalidity statement on main media in the place of registration before applying to the Commerce Bureau for a new one.

  批准证书不得伪造、涂改,不得买卖、出租、转借、质押或者以任何其他形式转让。

  It is forbidden to forge or alter the approval certificate, or buy, sell, lease, lend, pledge or transfer the certificate in any other form.

  已变更、注销、吊销或到期换证的批准证书应交回发证机关,其他任何单位和个人不得私自收存。

  The approval certificate that has been changed, canceled, revoked or expired shall be returned to the issuing authority, and no other organization or individual shall collect and keep it without permission.

  第十四条 保税油经营企业要求变更批准证书事项的,向市商务局提出申请,经市商务局组织有关部门审核后,上报市政府审批,对具备继续从事保税油经营条件的,应准予换发变更的批准证书。

  Article 14 To change information on its approval certificate, a bonded oil operation company shall apply to the Commerce Bureau, and the latter, after organizing relevant departments for review, shall submit the same to the municipal government for approval. An applicant meeting the requirements for continuing to engage in bonded oil operations shall be granted a new certificate with changed information.

  保税油经营企业股东未发生变更,其他事项发生变更的,应在申请时提供变更佐证材料。

  Where the shareholders of the bonded oil operation company remain unchanged, but other information is changed, supporting documents shall be provided along with the certificate change application.

  保税油经营企业股东发生变更的,必须办理相应经营资格的注销手续,并重新申办保税油经营资格。

  Where the shareholders of the bonded oil operation company are changed, the company must go through the procedures for cancellation of operation qualification, and submit a new application for bonded oil operation qualification.

第三章 保税油经营规范

Chapter III Bonded Oil Operation Rules

  第十五条 保税油经营企业必须按照国际公约要求、国际航行船舶用油品的国际、国家质量标准及船舶供受燃油管理规程,按质保量开展供应业务。

  Article 15 Bonded oil operation companies shall carry out supply business with the required quality and quantity per the requirements of international conventions, international and national quality standards for bonded oil for vessels engaged on international voyages and the management regulations on vessel fuel supply and acceptance.

  第十六条 保税油经营企业应建立单独的油品进、销、存和出入库的管理台账,保留证明保税油来源和销售去向的凭证、票据等资料。

  Article 16 Bonded oil operation companies shall establish a separate management register for the purchase, sale, storage, inbound and outbound processes of oil products, and retain the vouchers, bills and other documents proving the source and sales destination of the bonded oil.

  第十七条 保税油经营企业应建立完善的质量、安全和环境保护管理制度。供应船舶作业中应严格按照安全规程和油罐安全管理规定进行操作。

  Article 17 Bonded oil operation companies shall establish sound quality, safety and environmental management rules. Supply vessels shall be operated in strict accordance with safety rules and tank safety management rules.

  第十八条 保税油经营企业必须依法经营,严禁发生下列行为:

  Article 18 Bonded oil operation companies must operate according to the law, and are prohibited to:

  (一)超越批准证书范围经营;

  (i) operate beyond the business scope specified in the approval certificate;

  (二)从事保税油走私等行为;

  (ii) engage in bonded oil smuggling;

  (三)超越水路运输业务的许可范围经营;

  (iii) operate beyond the permitted scope of water transport business;

  (四)擅自交付、发运海关监管货物等违法违规行为;

  (iv) violate laws and regulations, such as delivering or shipping goods under customs supervision without authorization;

  (五)销售无法证明合法来源的保税油;

  (v) sell bonded oil without a proven legal source;

  (六)擅自改动质量流量计或利用其他手段克扣油量;

  (vi) modify the mass flow meter without authorization or deduct the oil quantity in other ways;

  (七)掺杂掺假、以假充真、以次充好;

  (vii) replace authentic and superior bonded oil with fake and poor-quality oil;

  (八)销售国家明令淘汰、禁止销售、质量不合格、不符合质量标准和不符合大气排放控制标准的保税油;

  (viii) sell bonded oil that has been eliminated or prohibited by official order, is unqualified, does not meet quality standards and gas emission standards;

  (九)不按水上交通安全法律法规规定落实有关作业安全和防污染措施;

  (ix) fail to implement operational safety and pollution prevention measures according to the water traffic safety laws and regulations;

  (十)违反船舶消防安全法律法规,不按规定配置消防器材、设施或消防安全标志;

  (x) violate vessel fire safety laws and regulations, and fail to equip vessels with fire-fighting equipment, facilities or fire safety signs as required by regulations;

  (十一)违反出入境管理法规,违规搭靠外轮、违规登轮及擅自出入境等行为;

  (xi) violate the exit and entry administration laws and regulations, moor to foreign vessels and board on vessels in violation of regulations, and enter and exit without authorization;

  (十二)国家、省、市有关法律法规、规章和规范性文件禁止的其他行为。

  (xii) act in violation of relevant national, provincial and municipal laws, regulations, rules and normative documents.

第四章 监督管理

Chapter IV Supervisory Management

  第十九条 属地区政府(含大鹏新区、深汕特别合作区管委会)应建立定期检查及不定期抽查制度,建立企业的信用档案制度;通过设立并公布举报电话、电子邮箱或微信公众号等方式,接受对违反本办法行为的投诉和举报。

  Article 19 District governments (including the Administrative Committees of Dapeng New District and Shenshan Special Cooperation Zone) shall establish a regular inspection and irregular spot check mechanism, and a company credit filing system, and set and publish a report phone number, email address or WeChat public account to accept complaints and reports on violations of these Measures.

  第二十条 属地区政府(含大鹏新区、深汕特别合作区管委会)、市商务局、市交通运输局、深圳海关、深圳海事局、深圳边检总站、市发展改革委、市公安局、市财政局、市规划和自然资源局、市海洋发展局、市生态环境局、市应急管理局、深圳市消防救援局、市国资委、市市场监管局、市地方金融管理局、市口岸办、深圳市税务局、国家金融监督管理总局深圳监管局、人民银行深圳市分行(国家外汇管理局深圳市分局)、深圳海警局、广东海警局直属分局等单位按照各自行政管理职责,加强对保税油经营行为的监督检查,对保税油经营企业的违法违规行为进行查处,对供应船舶和油罐的经营安全进行监督检查,并将查处情况及时通告市商务局,同时将应当公开的行政处罚决定等事项依法向社会公开。

  Article 20 District governments (including the Administrative Committees of Dapeng New District and Shenshan Special Cooperation Zone), the Commerce Bureau of Shenzhen, Transport Bureau of Shenzhen, Shenzhen Customs, Shenzhen Maritime Safety Administration, Shenzhen Exit-Entry Border Checkpoint, Development and Reform Commission of Shenzhen, Public Security Bureau of Shenzhen, Finance Bureau of Shenzhen, Planning and Natural Resources Bureau of Shenzhen, Marine Development Bureau of Shenzhen, Ecology and Environment Bureau of Shenzhen, Emergency Management Bureau of Shenzhen, Fire and Rescue Bureau of Shenzhen, State-owned Assets Supervision and Administration Commission of the People's Government of Shenzhen Municipality, Market Regulation Bureau of Shenzhen, Local Financial Regulatory Bureau of Shenzhen, Office of Port of Entry and Exit of the People's Government of Shenzhen, Shenzhen Municipal Office of the State Administration of Taxation, Shenzhen Municipal Office of the National Financial Regulatory Administration, Bank of China Shenzhen Branch (Shenzhen Office of State Administration of Foreign Exchange), Shenzhen Coast Guard, and direct branches of Guangdong Coast Guard shall, as per their administrative responsibilities, ramp up the supervision and inspection of bonded oil operations, investigate and punish bonded oil operation companies with rule-violating acts, supervise and inspect the operational safety of supply ships and oil tanks, and promptly notify the Commerce Bureau of the investigation and punishment results, and at the same time disclose the administrative penalty decisions and other matters that should be made public to the public according to the law.

  第二十一条 保税油经营企业连续停歇业6个月以上的,需到市商务局办理保税油经营资格停歇业手续。

  Article 21 Bonded oil operation companies having suspended or ceased business for more than 6 consecutive months shall go through the procedures for suspension or cessation of bonded oil operations.

  保税油经营企业主动终止经营的,需到市商务局办理保税油经营资格注销手续,由市商务局上报市政府审批。

  Bonded oil operation companies voluntarily terminating their operations shall go through the procedures for cancellation of bonded oil operation qualification at the Commerce Bureau, and the latter shall report the same to the municipal government for approval.

  第二十二条 市商务局会同属地区政府(含大鹏新区、深汕特别合作区管委会)每年度组织对保税油经营企业经营情况进行检查(以下简称年检)。企业应配合年检工作,需年检的内容包括:

  Article 22 The Commerce Bureau shall work with the district governments (including the Administrative Committees of Dapeng New District and Shenshan Special Cooperation Zone) to inspect bonded oil operation companies’ operations annually (hereinafter referred to as “annual inspection”). A bonded oil operation company shall be cooperative in the annual inspection, which shall cover:

  (一)企业上年度经营状况;

  (i) the company's operating status last year;

  (二)企业最新注册信息;

  (ii) the company's latest registration information;

  (三)相关证照及租赁合同是否在有效期内;

  (iii) whether the relevant licenses and lease contracts are within the validity period;

  (四)企业是否有走私行为或者重大违法违规行为;

  (iv) whether the company has committed smuggling or gross violations of laws and regulations;

  (五)企业是否存在违反法律、法规规定的其他情形。

  (v) whether the company has violated other laws and regulations.

  第二十三条 保税油经营企业年检结果分为:

  Article 23 The results of the annual inspection of a bonded oil operation company include:

  (一)合格;

  (i) Pass;

  (二)不合格;

  (ii) Fail;

  (三)停歇业;

  (iii) Suspension or cessation of business;

  (四)未参加年检。

  (iv) Failure to participate in the annual inspection.

  未参加年检及年检不合格的保税油经营企业,由市商务局等单位责令限期年检或整改。对于停歇业的企业,需要在重新营业前完成年检,若年检合格则照常经营,若不合格则限期整改。

  Where a company fails to participate in the annual inspection or fails the inspection, the Commerce Bureau and other departments shall order it to participate in the inspection or make rectifications within a given timeframe. Where a company has suspended or ceased operation, the company shall complete the annual inspection before resuming the business. The company may resume the operations as usual if it passes the inspection, and shall make rectifications within a timeframe if it fails the inspection.

  第二十四条 企业在申请时隐瞒有关情况或者提供虚假材料的,市商务局不予受理,并按照有关法律法规处理。

  Article 24 Where a company conceals relevant information or provides false documents when applying, the Commerce Bureau shall not accept it and shall deal with it per relevant laws and regulations.

  第二十五条 已取得批准证书的企业出现《中华人民共和国行政许可法》第七十条所列情形,行政机关应当依法办理有关注销手续的,由市商务局审核后报请市政府审批,注销行政许可,并收回批准证书或者予以公告。

  Article 25 Where a company that has obtained an approval certificate falls under any of the circumstances set out in Article 70 of the Administrative License Law of the People's Republic of China and the administrative organ shall go through cancellation procedures according to law, the Commerce Bureau shall review the cancellation and report the same to the municipal government for approval, cancel the administrative license, and withdraw the approval certificate or make a public announcement.

  第二十六条 保税油经营企业在经营过程中发生违法违规行为的,由相关行政管理部门按照法律、法规、规章及有关规定进行处罚。

  Article 26 Where a bonded oil operation company violates laws and regulations in the course of its operations, it shall be punished by the relevant administrative departments according to relevant laws, regulations, rules and relevant provisions.

第五章 附则

Chapter V Supplementary Provisions

  第二十七条 本办法自2024年8月3日起施行,有效期5年。

  Article 27 These Measures shall come into force on August 3, 2024, with a validity period of five years.
